Terms of Service

1. Introduction and Agreement

These Terms of Service ("Terms") govern your access to and use of the website Hard Money Lenders of Orange County (the "Site"), operated by Lead Skills, LLC ("we," "us," or "our"). By accessing the Site, submitting an inquiry, or otherwise using the services offered through the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, do not use the Site.

2. Our Role: Lead Generation Service

The Site is a lead-generation service. We connect borrowers with participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions — including approval, denial, rates, points, fees, loan-to-value, loan terms, and funding timelines — are made solely by the participating lender. A current list of participating lenders is available upon request.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer or solicitation to lend, a commitment to make a loan, or a guarantee of any loan terms. Any rates, ranges, timelines, or loan scenarios described on the Site are illustrative only, reflect typical programs offered by participating lenders, and are subject to change without notice. Availability, terms, and qualifications vary by lender, property, borrower, and transaction.

4. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Site or submit an inquiry. You represent and warrant that the information you provide is accurate, complete, and current, and that you are the individual described in the inquiry or are authorized to submit the inquiry on behalf of that individual or entity.

5. Your Consent to Be Contacted

When you check the consent box and submit an inquiry, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP to any text or calling 714-455-3067.

6. Equal Opportunity

The Site connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age. If you believe you have experienced discrimination, you may report the conduct to the participating lender, to the appropriate federal or state regulator, and to us at the contact information below.

7. Acceptable Use

You agree not to:

• Submit false, inaccurate, or misleading information.
• Use the Site for any unlawful purpose or in violation of any applicable law.
• Attempt to interfere with, disrupt, or circumvent any security or access control on the Site.
• Scrape, copy, reverse engineer, or exploit any part of the Site except as permitted by these Terms.
• Submit an inquiry on behalf of another person without that person's authorization.
• Upload or transmit viruses, malware, or any code designed to disrupt or damage the Site.

8. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of Lead Skills, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for personal, non-commercial use. Any other use — including reproduction, modification, distribution, or public display — requires our prior written consent.

9. Third-Party Links and Services

The Site may contain links to third-party websites, resources, or services, including those of participating lenders. We do not control and are not responsible for the content, policies, or practices of any third party. Your interactions with third parties, including participating lenders, are solely between you and the third party. Review the third party's own terms and privacy policy before engaging.

10. Disclaimers

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING ANY LOAN PROGRAM, LENDER, OR OUTCOME ASSOCIATED WITH YOUR INQUIRY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LEAD SKILLS, LLC, ITS AFFILIATES, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, ANY INQUIRY SUBMITTED THROUGH THE SITE, OR ANY INTERACTION WITH A PARTICIPATING LENDER. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your inquiry or any information you submit, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. You irrevocably submit to the exclusive jurisdiction of the state and federal courts located in California for any dispute arising out of or relating to these Terms or the Site.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Material changes may be communicated by additional notice. Your continued use of the Site after the revised Terms take effect means you accept the changes.
